Terms of Service

1. The Service

Arab Whale, operated by Arab Whale, is a cloud-based (SaaS) platform that provides AI-powered business tools including content generation, customer messaging, campaign management, analytics, and related features.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Provide accurate information and keep it up to date. You must be at least 18 years old or have legal authority to enter into these Terms.

3. Acceptable Use

You agree not to misuse the Service, including: unlawful activity, fraud, spam, infringing intellectual property, uploading malware, attempting to breach security, scraping, or interfering with other users.

4. Subscriptions & Billing

Paid plans are billed in advance on a recurring monthly basis until canceled. Prices are shown on our Pricing page. Subscriptions renew automatically at the end of each billing period.

Payment, invoicing, tax, and billing mechanics are handled by our reseller Paddle. For details, see the Paddle Buyer Terms.

5. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries relating to payment and handles returns.

6. Cancellation

You may cancel your subscription at any time from your account settings. On cancellation, your paid access continues until the end of the current billing period; no partial refunds are issued for the unused portion. See our Refund Policy for details.

7. Refunds

Refunds are handled under our Refund Policy.

8. Intellectual Property

The Service, including software, design, and branding, is owned by Arab Whale. You retain ownership of the content you create using the Service. You grant us a limited license to host and process your content solely to provide the Service.

8a. AI Outputs

The Service uses artificial intelligence to generate text, images, brand assets, websites, marketing copy, replies, and other outputs. AI outputs may be inaccurate, incomplete, biased, or otherwise unsuitable for your purpose. You are responsible for reviewing, editing, and verifying every AI output before you rely on it, publish it, or send it to a customer. Arab Whale does not warrant the factual correctness, legality, or fitness for purpose of any AI output.

8b. User Content

You represent and warrant that you own, or have all necessary rights, licenses, and consents to use, any content, data, logos, images, text, contacts, or other material you upload, submit, or otherwise provide to the Service. You are solely responsible for the legality of that material, including compliance with intellectual-property, privacy, data-protection, and advertising laws.

8c. Generated Branding

Names, logos, taglines, color systems, and other brand assets produced by the Service are algorithmic outputs and may unintentionally resemble existing trademarks, trade names, or copyrighted works. Arab Whale performs no trademark clearance and grants no trademark rights. Before using any generated brand asset commercially, you are responsible for conducting appropriate trademark, copyright, and legal clearance in every jurisdiction where you intend to use it.

8d. Generated Websites

Websites and pages generated or hosted through the Service are your content. You are responsible for all published claims, prices, product descriptions, testimonials, legal disclosures (including privacy notices, terms, cookie notices, and refund policies), and for the accuracy, legality, and regulatory compliance of everything published under your account.

8e. WhatsApp and Meta Integrations

If you connect a WhatsApp Business, Meta, or similar messaging integration, you are responsible for obtaining and maintaining lawful consent from every recipient before sending them messages, and for complying with the WhatsApp Business Messaging Policy, Meta Platform Terms, applicable anti-spam laws (including CAN-SPAM, CASL, GDPR / ePrivacy, TCPA, and equivalents), and any applicable telecommunications regulations. You must not use the Service to send unsolicited, deceptive, harassing, fraudulent, adult-only, or otherwise prohibited content, or to bypass opt-out requests. We may suspend WhatsApp features immediately without notice if we, Meta, or a regulator believe your use violates these rules.

8f. Third-Party Services

The Service depends on third-party providers, including cloud hosting, AI model providers, payment processors, and communication platforms (such as Meta / WhatsApp, Google, and Paddle). Availability, performance, and behavior of these external services are outside our control and may change or become unavailable. Your use of those services is also subject to their own terms.

9. Service Availability

We strive to maintain high availability but do not guarantee that the Service will be uninterrupted or error-free.

10. Termination & Suspension

We may suspend or terminate access, with or without prior notice, for: material breach of these Terms, non-payment, fraud, spam or abusive automation, sending unlawful or prohibited content, security attacks or attempts to compromise the Service or other users, violation of third-party platform policies (including Meta / WhatsApp), or any other conduct we reasonably believe risks harm to the Service, our users, or third parties.

11. Disclaimer & Limitation of Liability

The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages.

12. Changes

We may update these Terms. Continued use of the Service after changes constitutes acceptance of the updated Terms.
